The case of Murray Energy v. HBO and John Oliver has been adjudicated and DISMISSED by the Presiding Judge in West Virginia.
Marshall County Court Judge Jeffrey D. Cramer found
“the arguments set forth in the Defendants’ Motion to Dismiss . . . well-founded, appropriate in this matter and will grant the same.”
The Media giants had stood firmly on first amendment grounds, defending against Plaintiffs’ defamation claims on the grounds that the segment’s statements were either (a) true, or (b) jokes. Without fanfare, Judge Cramer wrote
“[t]he Court adopts, with little exception, Defendants’ arguments in support of their Motion regarding all issues . . . .”
The two-page Order dismisses the case ‘with prejudice’, extinguishing the claims as having been adjudicated and closing off any chance of the action being filed again. The losing parties, Plaintiffs Murray Energy and other coal companies, have the right to appeal within 30 days.
Meanwhile, Defendants have the honor of drafting their own victory:
“Counsel for the Defendants shall prepare and forward a proposed Order, including findings of fact and conclusions of law supporting the Court’s ruling. The same shall be forwarded within 20 days . . . .”
